Yeah that mine locomotive is at the Lackawanna Mine Tour, slope 190.
I guess the approved ventilation and escape ways wouldn't allow it to pass mining regulations, but so long you aren't mining coal and you get an insurance company to cover you without being inspected by DEP, which essentially if only required for active mines, I don't see why they couldn't open it up. I doubt the mine tours in NJ are inspected by any mining firms. They aren't mining and aren't listed as active mines. Mt. Hope was the only "active mine" listed in NJ up until a few years ago when the flood which took out the transformers.
